TERM BARANG YANG DILARANG
Merupakan tanggung jawab Penjual untuk memastikan bahwa barang yang mereka ajukan mematuhi semua undang-undang dan diizinkan untuk didaftarkan untuk dijual sesuai dengan ketentuan dan kebijakan DiMENU sebelum pendaftaran barang pada platform penjualan. Untuk kenyamanan Penjual, di bawah ini DiMENU telah menyediakan pedoman singkat tentang barang yang dilarang dan dibatasi yang tidak boleh dijual di DiMENU. DiMENU akan memperbarui pedoman ini dari waktu ke waktu bila diperlukan. Silakan kunjungi halaman ini secara teratur untuk melihat pembaruan.
1. PELANGGARAN TERHADAP PERSYARATAN LAYANAN KAMI
Pelanggaran terhadap Kebijakan Barang yang Dilarang dan Dibatasi ini dapat membuat Penjual dikenai berbagai tindakan yang merugikan, termasuk tetapi tidak terbatas pada salah satu atau semua hal berikut:
(i) Penghapusan daftar;
(ii) Batasan diberlakukan pada hak Akun;
(iii) Penangguhan dan pengakhiran akun; dana
2. DAFTAR BARANG YANG DILARANG DAN DIBATASI
Barang Terkait Makanan dan Minuman
(i) Minuman keras atau beralkohol;
(ii) Segala jenis obat-obatan maupun zat-zat lain yang dilarang ataupun dibatasi peredarannya menurut ketentuan hukum yang berlaku, termasuk namun tidak terbatas pada ketentuan Undang-Undang Narkotika, Undang-Undang Psikotropika, dan Undang-Undang Kesehatan di Republik Indonesia. Termasuk pula dalam ketentuan ini adalah obat keras, obat-obatan yang memerlukan resep dokter, obat bius, obat pelangsing dan sejenisnya, atau obat yang tidak memiliki izin edar resmi dari Badan Pengawas Obat dan Makanan (BPOM);
(iii) Kosmetik yang tidak memiliki izin edar resmi dan kosmetik bekas;
(iv) Makanan yang Dilarang: Untuk keselamatan Pengguna kami, Penjual tidak boleh mendaftarkan makanan dan barang terkait makanan berikut ini di Situs kami:
• Makanan minuman yang membahayakan keselamatan penggunanya, ataupun yang tidak mempunyai izin edar dari Badan Pengawas Obat dan Makanan (BPOM);
• Daftar yang mengandung klaim obat-obatan - yaitu, klaim bahwa barang tersebut dimaksudkan untuk digunakan dalam diagnosis, penyembuhan, peringanan, perawatan, atau pencegahan penyakit pada manusia dan/atau binatang, kontrasepsi, anestesi atau mencegah maupun mengganggu fungsi fisiologis normal, baik secara permanen atau pun sementara, dan baik dengan cara mengakhiri, mengurangi atau menunda, atau meningkatkan atau mempercepat jalannya fungsi tersebut atau dengan cara lain apapun (misalnya, obat-obatan farmasi, lensa kontak, suplemen makanan dengan pelabelan yang salah);
• Makanan yang berbahaya - Makanan yang mengandung zat terlarang atau zat yang melebihi proporsi yang diizinkan, makanan yang tercemar tanpa sepenuhnya memberi tahu Pembeli pada saat penjualan tentang sifat transaksi;
• Produk susu non-pasteurisasi;
• Jamur liar; dan
• Makanan lainnya yang berbahaya bagi kesehatan manusia.
Makanan yang tidak termasuk ke dalam kategori Makanan yang Dilarang di atas harus mematuhi standar minimum dan pedoman berikut ini:
• Tanggal kedaluwarsa – Makanan yang sudah kedaluwarsa tidak boleh didaftarkan;
Barang Elektronik yang Dibatasi
(v) Peralatan telekomunikasi, pengawasan elektronik dan peralatan elektronik serupa seperti TV kabel, pelaras acakan, pemindai radar, perangkat kendali sinyal lalu lintas, perangkat penyadapan dan perangkat penyadap telepon;
(vi) Produk telepon genggam/handphone baru (termasuk perangkat tablet yang penggunaannya membutuhkan simcard untuk beroperasi) yang tidak memiliki atau belum memperoleh izin teknis dari instansi yang berwenang. Penjual yang menjual produk telepon genggam/handphone baru di Situs wajib memastikan bahwa produk tersebut telah memiliki izin teknis dari instansi terkait sebagai syarat dapat diperjualbelikan di Indonesia. Penjual yang menjual telepon genggam/handphone baru yang tidak memiliki atau belum memperoleh izin teknis dari instansi yang berwenang di Situs akan dikenakan sanksi yang berupa namun tidak terbatas pada pemblokiran dan/atau penghapusan barang dari Situs;
Barang Terkait Hak Kekayaan Intelektual, Konten, dan Jasa
(vii) Publikasi, buku, film, video dan/atau video game yang tidak mematuhi hukum yang berlaku di negara tempat penjualan dan/atau pengiriman;
(viii) Barang-barang yang berpotensi melanggar: Barang-barang termasuk tetapi tidak terbatas pada replika, barang palsu, dan tiruan produk atau barang tanpa izin yang mungkin membahayakan pengguna, melanggar hak cipta, merek dagang tertentu, atau hak kekayaan intelektual lainnya milik pihak ketiga;
(ix) Jasa: Kecuali secara tegas diizinkan oleh DiMENU, penyediaan jasa, termasuk tetapi tidak terbatas pada jasa yang bersifat seksual atau ilegal atau melanggar Persyaratan Layanan dilarang di Situs;
(x) Barang-barang dan atau jasa yang memuat konten dengan materi yang berpotensi menciptakan atau mempromosikan kebencian atau menghasut atau menyalahgunakan anak-anak atas dasar kepentingan politik, agama, jenis kelamin, orientasi seksual, ras, etnis, usia, atau cacat tubuh;
(xi) Produk yang (i) terkait dengan kampanye, pemilihan umum, isu politik, atau isu debat politik (b) dan mengadvokasi atau melewan, atau menyerang politisi atau partai politik, atau (c) mempromosikan atau menghasut timbulnya setiap bentuk kebencian, kejahatan, prasangka, pemberontakan, atau kekerasan; dan
(xii) setiap barang yang, atau mengandung komponen yang (i) ilegal atau terlarang lainnya di yurisdiksi Pembeli dan/atau Penjual atau barang yang mendorong kegiatan ilegal atau terlarang, atau (ii) ditentukan oleh suatu badan pemerintahan atau otoritas pemerintahan sebagai barang yang berpontensi menimbukan resiko gangguan kesehatan atau keamanan.
Barang Umum
(xiii) Segala jenis hewan dan satwa yang dilarang diperjualbelikan berdasarkan hukum Republik Indonesia;
(xiv) Artefak dan barang antik dan cinderamata berbahan hewan yang dilindungi;
(xv) Mata uang dan prangko palsu;
(xvi) Kartu kredit dan debit;
(xvii) Mata uang termasuk, dengan tidak terbatas pada, mata uang digital;
(xviii) Barang yang diembargo;
(xix) Senjata api, senjata seperti semprotan merica, replika senjata api termasuk replika senjata jenis airsoft gun dan replika senjata jenis paintball, dan senjata bius, dsb;
(xx) Barang yang berkaitan dengan pemerintah atau Polisi seperti lencana, tanda pangkat atau seragam;
(xxi) Bagian tubuh atau jenazah manusia;
(xxii) Alat pembobol kunci;
(xxiii) Tiket lotre;
(xxiv) Pestisida;
(xxv) Mesin slot, dan barang lain terkait perjudian;
(xxvi) Barang yang sudah ditarik dari peredaran;
(xxvii) Saham, surat berharga dan prangko lainnya;
(xxviii) Produk tembakau atau terkait tembakau, termasuk dengan tidak terbatas pada rokok elektronik;
(xxix) Bahan yang cabul, menghasut atau berbau makar
(xxx) Barang curian;
(xxxi) Barang dengan hak Distribusi Eksklusif yang hanya dapat diperdagangkan dengan system penjualan langsung oleh penjual resmi dan/atau Barang dengan sistem penjualan Multi Level Marketing;
(xxxii) Barang yang tidak memenuhi ketentuan SNI, pelabelan, penggunaan Bahasa Indonesia yang diatur oleh Kementrian Perdagangan.
(xxxiii) Bahan yang diklasifikasikan sebagai Bahan Berbahaya menurut Peraturan Menteri Perdagangan dan yang berlaku.
Apabila Anda melihat daftar yang melanggar kebijakan kami, silakan laporkan kepada kami dengan mengeklik tombol "Lapor Penyalahgunan" pada menu link footer. Ketika pelanggaran kebijakan terjadi, kami akan mengirimkan email, pesan sistem dan pemberitahuan push kepada Penjual untuk memberi tahu mereka bahwa daftar telah dihapus dari Situs Web kami. Kami juga akan mengirimkan pemberitahuan push kepada Pembeli tentang daftar tersebut.
